Credit Card Debt Collection Practice Industry Grows With Increasing Debt
Credit card debt collection practice is becoming more commonplace as consumers are falling further into debt. With the economic crisis growing larger, many are using credit cards to pay for the basic necessities: groceries, gasoline, and other bills.As credit card usage has continued to increase, so has the delinquency rate, with more and more falling behind and defaulting on timely payments. When the bank's internal collection practice fails with these delinquent accounts, an outside collection agency is often brought in to help. When it comes to credit cards, the debt collection practice of third party collection agencies are a bit more involved. There are a number of ways a collection agency may employ to contact the debtor. The first contact more often than not, is a letter. This can serve as a reminder of the debt, with the amount owed, the original creditor's information, as well as the contact information for the collection agency. The debtor has the right to dispute the debt in question, and has to provide a timely response, if disputing it. If the debt is legitimate, the debtor should proactively try to resolve the matter with the collection agency. Third party collection agencies have to abide by laws stipulated in the federal Fair Debt Collections Practices Act, which forbid threatening and abusive language, among other things, when communicating with debtors. A reputable agency will often work with debtors, since their goal is to satisfy the outstanding debt. Communicating clearly and honestly, and in writing, with the collection agency is always best. Payment arrangements can be made, and oftentimes, payment settlements of less than the original amount owed are offered. Just make sure that any settlement and/or payment arrangements are secured in writing before agreeing to them. As economic forecasts predict a worsening economy, with more job layoffs expected and the further tightening of credit availability, it is also expected that more Americans may be tempted to use their credit cards to "ride out" this difficult storm. With that, it can be reasonably predicted that credit card debt collection will increase as well. This practice may include banks calling in their debts for much-needed liquidity.
