Understanding Collection Agencies

by Anonymous
(Cortland,NY,USA)

The people who work for collection agencies are the hardest working people ever! They will call you all day long, and they will call you seven days a week.

I personally do not understand the purpose. I'm sure the people they contact are aware of their debts. I'm sure they are aware their unpaid debts will go on their credit report. I feel this whole process is a waist of time and money!

As I stated earlier, most people are aware of their debts, and if they had any intentions paying, then they would have paid already. Do they really think being rude and harassing will make someone pay? Are they trying to intimidate? I would like to know how these companies are funded. There are laws against harassing phone calls. Phone calls from collection agencies can qualify as harassment.

Another thing I don't understand is their thought process. They think they can have several different collection agents from the same collection agency call you within the same day and that doesn't count as harassment.

You may have spoken to a particular agent once that day, but still receive twenty more calls from 10 different agents. This story comes from experience. I Have been harassed by collection agencies while in the hospital with life-threatening illness. They do not care when or how many times they call.

If you feel you are being harassed by a collection agency, then you may want to file a complaint. Make sure you have the agency's contact information. Make sure you document the times and dates they call. Make sure you get the agent's name.
Just because you owe a debt does not mean you deserve to be harassed.

In Defense of Collection Agencies
by: David

While there are collection agencies that unfortunately violate federal and state laws prohibiting harassing and abusive behavior, collection agencies are fully within their rights to collect unpaid debt on behalf of the businesses that hire them to collect.

The distinction has to be made as to whether or not a collection agency is operating outside of clearly defined federal and state regulations that govern collection agency practices. Merely receiving phone calls from debt recovery companies doesn't inherently constitute harassment. Its only when they behave counter to FDCPA laws that they can be cited for harassment.

Its also true that while receiving a phone call from a collection agency isn't necessarily a pleasant, nor desirable experience, they do prove very successful in recovering money owed to businesses from delinquent customers who, for whatever reason, have chosen to ignore communications from their original debtors.

Collection agencies act as neutral third parties, and because many of them have the ability to report negative information to the credit bureaus, this often serves as a powerful enough incentive to get some people to honor their debt obligations: something they should be doing anyway!

So yes, collection agencies are very successful in their efforts. Look at this way: in addition to serving a very useful function to the health of the overall economy, collection agencies wouldn't be necessary if people paid the bills they created in the first place.

Having said that, there is absolutely no excuse for collection agencies behaving in an abusive, threatening or harassing manner attempting to collect money. And there are agencies that do their work in an ethical, humane way.
